Draft — pending legal review. This page is a first draft. It is not yet in effect and will change before launch.
Terms of Service
These terms are the agreement between you and DraftIQ for using the DraftIQ website and app. Please read them; by creating an account or using DraftIQ, you agree to them. Our Privacy Policy explains how we handle your information.
Who we are
DraftIQ is operated by [PLACEHOLDER: legal entity name], [PLACEHOLDER: mailing address] (“DraftIQ”, “we”, “us”). Contact: [PLACEHOLDER: contact email].
What DraftIQ is
DraftIQ is a research tool for short-form video. It finds Instagram and TikTok videos that perform well compared with their creator’s usual results, groups them into formats and trends, analyzes how they are made, and lets you save, tag and follow what you find.
DraftIQ is an independent service. It is not affiliated with, endorsed by or sponsored by Instagram, Meta, TikTok or ByteDance.
Who can use DraftIQ
You must be at least [PLACEHOLDER: minimum age] to create an account. If you use DraftIQ for a business or client, you confirm you are allowed to accept these terms on its behalf.
Your account
- You sign up with an email address and a password, and confirm the address through a link we email you.
- Give us an email address you control, and keep your password private. You are responsible for what happens in your account. Tell us at [PLACEHOLDER: contact email] if you think someone else has used it.
- Each account belongs to one person. Don’t share your sign-in with others.
Price
DraftIQ is currently free, and we do not take payment details. We plan to offer paid plans later. If we do, we will explain their prices and what they include before you are asked to pay, and nothing will be charged without your agreement.
Using DraftIQ fairly
Please don’t:
- copy, scrape, resell or redistribute DraftIQ’s data or analysis in bulk, or use it to build a competing product;
- use automated tools to access the app;
- try to get into other people’s accounts or parts of DraftIQ you are not given access to, or interfere with how the service runs;
- use DraftIQ to harass, stalk, impersonate or harm creators or anyone else;
- use DraftIQ in a way that breaks the law or anyone else’s rights.
We may suspend or close an account that breaks these rules.
Videos and creators shown in DraftIQ
DraftIQ shows and analyzes publicly available Instagram and TikTok videos and their public statistics. Those videos, and the rights in them, belong to their creators. DraftIQ helps you study them as references; it does not give you any right to reuse them.
- Don’t download, repost or present someone else’s video as your own.
- Ideas, formats and trends are there to inspire your own work; respect creators’ copyrights, trademarks and other rights when you make it.
- Statistics such as views, likes and comments are what the platforms showed publicly when we recorded them. They can change, and some may be missing for a video; we show them as “not available” rather than guessing.
If you are a creator with a question or concern about your content in DraftIQ, contact us at [PLACEHOLDER: contact email].
AI analysis can be wrong
DraftIQ uses AI models to describe videos, for example their hook, format, speaking style, transcript and on-screen text, and to group videos into formats and trends. These analyses are automated and can be incomplete or wrong. A trend’s stage and a breakout label describe what DraftIQ has recorded so far; they are not predictions or promises about how a video, trend or account will perform. Check anything important before you rely on it, and use your own judgment when you plan content.
Your content
The workflows, notes, tags and descriptions you add stay yours. You let us store and process them only to run DraftIQ for you. If you request a niche we don’t cover yet and we add it, the niche itself (its name and description) becomes part of DraftIQ for all customers.
Don’t put anything in DraftIQ that you don’t have the right to share, or that contains other people’s private information.
Our service
- DraftIQ’s software, design, analysis and the way we organize information belong to us. You may use them only as part of using DraftIQ under these terms.
- DraftIQ is a new service. We may change, add or remove features, and the service may sometimes be unavailable. We will try to give notice of major changes.
- Which videos, creators and niches DraftIQ covers depends on what we can record, and coverage can change.
Ending your account
You can stop using DraftIQ at any time and delete your account in Settings. For help, contact us at [PLACEHOLDER: contact email]. We may suspend or close your account if you break these terms or if we stop offering DraftIQ; where we reasonably can, we will tell you first.
Disclaimers
DraftIQ is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, or that its data and analysis are accurate or complete. Some places do not allow these exclusions, so they may not all apply to you.
Limits on our liability
To the extent the law allows, DraftIQ is not liable for indirect or consequential losses, such as lost profits, lost opportunities or lost data, arising from your use of DraftIQ. Our total liability to you for any claim about DraftIQ is limited to [PLACEHOLDER: liability cap, for example the amount you paid us in the last 12 months or a fixed sum]. Nothing in these terms limits liability that cannot be limited by law.
Governing law and disputes
These terms are governed by the laws of [PLACEHOLDER: governing law]. Disputes will be handled in [PLACEHOLDER: courts or dispute process]. Before starting a formal dispute, please contact us so we can try to resolve it.
Changes to these terms
We may update these terms. We will post the new version here with a new effective date, and tell you by email or in the app before an important change takes effect. If you keep using DraftIQ after that, the new terms apply; if you don’t agree, you can stop using DraftIQ and ask us to delete your account.
